In January 2019 we published a statement of approach outlining how the Inquiry would handle the warning letter procedure set out in the Inquiry Rules 2006. Today we have published an addition to that statement with further guidance.
The updated statement of approach makes clear that, in relation to the final report:
- the Chair must send a warning letter where he envisages including any explicit or significant criticism of that person
- the word “person” means legal person and so includes both organisations and individuals
- the warning letter can either include the relevant extract from the draft report or the criticism, facts and supporting evidence
- the correspondence related to such criticisms is subject to strict rules of confidentiality under the legislation
- the Inquiry will not enter into correspondence concerning the terms of, or amendments to, any criticism
